On Monday, officials from Raj Niwas revealed that the lieutenant governor of Delhi, Mr. V K Saxena, gave his approval for the establishment of medical boards in 11 districts in the city to handle issues relating to the Surrogacy (Regulation) Act, 2021.
On December 25, 2021, the Ministry of Health and Family Welfare made an announcement about the Act. According to Section 4(iii) of the Act, no gestational surrogacy or surrogacy operation may be conducted, undertaken, performed, or commenced unless the intended parents have a certificate from the relevant authorities (the district medical board) stating that gestational surrogacy is necessary.
An official source from the Delhi government stated that the Delhi government has kept the composition of the district medical boards (DMBs) delayed, which led intending beneficiaries to seek court as the regulation was notified by the central government. The sources also revealed that the chief medical officer, chief civil surgeon, or joint director of the health services in the district will serve as the chairperson of the DMB.
